Welcome to IdealGallery (IG), before you register with IG please read through the following terms and conditions as you will be asked to declare your agreement.
Hosting
Any website that you create via this service will remain the property of IG at all times. The information and images that you upload to the websites, however, are your responsibility and must confirm to our Website Content conditions shown below. IG web sites are normally available 24 hours a day, seven days a week. However, service availability is not guaranteed. Like other Internet-based services, IG web sites may be subject to external transmission problems that are beyond the control of IG. Accordingly, IG will not be responsible for any loss you may incur as a result of service being unavailable or delayed.
Website Content
Any text or images displayed uploaded to your site are your own responsibility. IG accepts no responsibility for any content that you display By uploading any material you confirm that you are the copyright owner or that you have the legal right to use that material. IG will undertake daily backup of all data - text and images on your site. In the event of a system failure an attempt will be made to restore this data but we do not commit to being able to do so Please ensure that you keep your own backups and understand that you use our services at your own risk.
We appreciate your need for creativity but will remove from your site anything which is considered unsuitable including, but not restricted to, pornographic images, violent images or any offensive text or images or otherwise lewd content. Material may be removed by IG at its sole discretion without reason given or warning issued.
Privacy Policy
This policy covers IG’s use of personal information that IG collects when you use idealgallery.co.uk.
From time to time, you will be asked to submit personal information about yourself (e.g. name and email address) in order to receive or use the services featured on our website. Such services include newsletters, a review of your marketing material and information requests regarding IG’s services and promotions. Should you opt to receive marketing material from us, at each delivery of such material you will be given the opportunity to remove yourself from our marketing list. If you have registered for a trial website with IG, you will be able to select whether or not you wish to receive marketing material at any time.
By entering your details in the fields requested, you enable IG to provide you with the services and/or information you select. Whenever you provide such personal information, we will treat that information in accordance with this policy. When using your personal information IG will act in accordance with current legislation and aim to meet current Internet best practice.
Please note that we do provide links to other sites, which may not be governed by this Privacy Policy and you should view the relevant policies of those sites for further information. IG is not responsible for the content of external internet sites, nor necessarily endorses them.
IG will take all reasonable precautions to protect the privacy of your account information. However, IG cannot guarantee that your data will not be subject to compromise attempts, be they successful or unsuccessful.
Use and storage of your personal information
When you supply any personal information to idealgallery.co.uk (e.g. for request for services or information) we have legal obligations towards you in the way we use that data. We must collect the information fairly, that is, we must explain how we will use it and will tell you if we want to pass the information on to anyone else.
In general, any information you provide to IG will only be used within IG. Your information will be disclosed where we are obliged or permitted by law. Also, if you send offensive, inappropriate or objectionable content anywhere on or to idealgallery.co.uk or otherwise engage in any disruptive behaviour on idealgallery.co.uk, IG can use whatever information that is available to it about you to stop such behaviour. This may involve informing relevant third parties such as your employer, school, e-mail/internet service provider, even law enforcement agencies about the content and your behaviour.
We will hold your personal information on our systems for as long as the service you have requested is available, and remove it in the event that you no longer wish to continue your registration with IG. We will ensure that all personal information supplied is held securely, in accordance with the Data Protection Act, 1998.
If you are notified on idealgallery.co.uk that your information may be used to allow IG to contact you, this means that IG may contact you for a number of purposes relating to the service or related services in which you have expressed interest.
It is the policy of IG not to transfer or sell to a third party any information it receives through idealgallery.co.uk.
Access to your personal information
You have the right to request a copy of the personal information that IG holds about you and to have any inaccuracies corrected. (We charge £10 for such requests.) Please address requests to the Data Protection Officer for whom the contact details are: dataprotection@idealgallery.co.uk
Refunds
All of our services are on an agreed fee basis and several products have a free trial available. We therefore expect that when you commit to one of our services you have done so in full knowledge of the service you will be receiving and how much you will be paying for it. Although we do our utmost to ensure that we provide you with the system that you require, we do not guarantee that our services will meet your requirements or that they will be free from error. We therefore cannot offer refunds except in very exceptional circumstances where it is clear that we have completely failed to provide the agreed service.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold IG harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against IG, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless IG against liabilities arising out of (1) any injury to person or property caused by any products sold or otherwise distributed in connection with IG`s server (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party (3) copyright infringement and (4) any defective products sold to customer from IG.
Disclaimer
IG reserves the right to revise its policies at any time.
In conjunction with The Supply of Goods and Services Act 1982 IG will carry out our work with reasonable care and skill.
IG provides web site design, software design and is a reseller of web hosting and domain names. IG reserves the right to suspend or cancel a customer`s access to any or all services provided by IG when IG decides that the account has breached the Terms of Service.
Payment policy
IG allow customers to pay for hosting services upfront or on a standing order or periodic payment basis. Customers paying by periodic payment should be aware that IG will provide 30 days warning in the event of non payment for any reason, after which IG reserve the right to suspend the customers account with no further warning.
Clients may switch between packages at any time subject to an administration fee at the prevalant rate - currently £10.
Term of Agreement
The minimum term of contract is 12 months, after this the client is free to leave at any time subject to 30 day's notice. For clients who have paid on an annual basis after the first year and who decide to cancel, they will receive a refund equal to the amount of time left on the annual contract on a pro rata basis - less an administration fee at the prevalant rate - currently £10.
